PayGunner proudly serves the firearms industry and supports the Second Amendment rights of law-abiding Americans. This policy prohibits only ILLEGAL transactions - we fully support and encourage legal firearms commerce.
Key Principle: Users are solely responsible for ensuring their transactions comply with all applicable laws. PayGunner is a payment processor only and does not verify the legality of underlying transactions.
What IS Allowed - Legal 2A Commerce
PayGunner SUPPORTS payment processing for all LEGAL firearms-related transactions, including:
- Firearms: Handguns, rifles, shotguns, and other legal firearms
- Ammunition: All calibers and quantities (where legal)
- Magazines: Standard and high-capacity magazines (where legal)
- NFA Items: Properly registered suppressors, SBRs, SBSs, AOWs with ATF approval
- Gun Parts & Accessories: Barrels, triggers, optics, scopes, sights, grips, stocks
- Knives & Edged Weapons: Tactical knives, pocket knives, fixed blades (where legal)
- Holsters & Gear: Concealed carry gear, tactical equipment, range bags
- Body Armor: Plates, carriers, protective equipment (where legal)
- Gunsmithing Services: Repairs, customization, cerakote, engraving
- Training & Education: Firearms training courses, safety classes, CCW classes
- Range Services: Range fees, memberships, target practice
- Hunting Equipment: Hunting licenses, tags, blinds, calls, decoys

2. Prohibited Firearm Transactions (ILLEGAL Items Only)
Illegal Firearms
- Unregistered NFA Items: Machine guns, silencers/suppressors, short-barreled rifles (SBRs), short-barreled shotguns (SBSs), destructive devices, or "any other weapons" (AOWs) that are not properly registered with ATF
- Post-1986 Machine Guns: Machine guns manufactured after May 19, 1986, for civilian ownership (unless transferee is SOT/FFL with proper authorization)
- Improvised or Homemade Firearms: Firearms manufactured without proper serial numbers or ATF Form 1 approval
- Stolen Firearms: Any firearm reported stolen or with obliterated serial numbers
- State/Local Prohibited Firearms: Firearms illegal under applicable state or local law (e.g., "assault weapons" in California, large-capacity magazines in restrictive states)
Sales to Prohibited Persons
Federal law (18 U.S.C. § 922(g)) prohibits firearm sales to certain categories of persons. PayGunner prohibits processing payments for sales to individuals who are:
- Convicted felons
- Fugitives from justice
- Unlawful users of or addicted to controlled substances
- Adjudicated as mental defectives or committed to mental institutions
- Illegal aliens or nonimmigrant visa holders (with limited exceptions)
- Dishonorably discharged from the Armed Forces
- Subject to domestic violence restraining orders
- Convicted of misdemeanor domestic violence crimes
- Under federal or state indictment for crimes punishable by more than one year imprisonment
- Persons who have renounced U.S. citizenship
Note: Sellers are responsible for ensuring buyers are not prohibited persons. FFL dealers must conduct NICS background checks.
Illegal Interstate Transfers
- Direct Interstate Sales: Shipping firearms across state lines without FFL involvement (except for long guns when permitted by both states' laws and conducted through FFL)
- Straw Purchases: Purchasing a firearm on behalf of someone who is prohibited from owning firearms
- Unlicensed Dealing: Engaging in business as a firearms dealer without proper FFL
Age-Restricted Sales
- Handgun sales to individuals under 21 years of age
- Long gun (rifle/shotgun) sales to individuals under 18 years of age
- Ammunition sales in violation of state or federal age restrictions
3. Prohibited Non-Firearm Items
Weapons and Explosives
- Explosives: Bombs, grenades, mines, dynamite, C4, or other explosive devices (except legally possessed with proper ATF permits)
- Chemical/Biological Weapons: Any chemical, biological, or radiological weapons
- Switchblades/Automatics: Automatic knives sold in violation of federal or state law
- Prohibited Weapons: Brass knuckles, blackjacks, saps, or other weapons illegal under state law
Controlled Substances
- Illegal drugs (marijuana, cocaine, heroin, methamphetamine, etc.)
- Prescription medications sold without valid prescription
- Drug paraphernalia
Counterfeit Goods and Fraud
- Counterfeit firearms, parts, or accessories
- Stolen goods or property
- Fraudulent identity documents
- Counterfeit currency
4. Prohibited Financial Activities
Money Laundering and Financial Crimes
- Structuring: Breaking up transactions to avoid reporting thresholds
- Money Laundering: Transactions designed to conceal the source of illegally obtained funds
- Terrorist Financing: Providing funds to designated terrorist organizations
- Sanctions Violations: Transactions with OFAC-sanctioned individuals, entities, or countries
Fraud and Misrepresentation
- Identity theft or use of stolen payment information
- False representation of goods or services
- Phishing or social engineering schemes
- Chargebacks abuse or friendly fraud
5. Prohibited Sellers and Buyers
5.1 Prohibited Sellers
PayGunner prohibits accounts for businesses or individuals engaged in:
- Unlicensed firearms dealing (engaging in business without FFL)
- Knowingly selling to prohibited persons
- Operating in violation of federal, state, or local law
- Previous violations of our Terms of Service
- Businesses on OFAC sanctions lists
5.2 Prohibited Buyers
Individuals may not use PayGunner if they:
- Are prohibited persons under 18 U.S.C. § 922(g)
- Intend to violate any federal, state, or local law
- Are purchasing on behalf of a prohibited person (straw purchase)
- Are located in sanctioned countries or on OFAC lists
6. Monitoring and Enforcement
